These Terms of Service govern your use of meariccalender.com and any commercial relationship with Mearic ("we", "us"). By accessing this website or placing an order, you agree to these terms. If you do not agree, please do not use this website or transact with us.
1. Website Use
You agree to use this website for lawful purposes only. Prohibited activities include: unauthorized scraping, denial of service attempts, malicious code injection, impersonation of Mearic or its representatives, and any use that infringes intellectual property or privacy rights of others. We may restrict or terminate access to users who violate these terms.
2. Intellectual Property
All content on this website — text, images, videos, product specifications, CAD drawings, schema, logos, and designs — is the property of Mearic or its licensors, protected by Turkish and international copyright, trademark, and related laws. You may not copy, reproduce, modify, or distribute any content for commercial purposes without written permission. Fair use for evaluation, comparison, or educational purposes is permitted with proper attribution.
3. Product Information
Technical specifications, dimensions, capacities, and features on this website reflect current production standards. Mearic reserves the right to modify specifications without prior notice as part of ongoing engineering improvements. Binding specifications are those stated in your individual quote, proforma invoice, or contract document.
4. Quotes and Orders
Online forms (Quote, Contact) initiate a commercial inquiry but do not constitute a binding contract. A binding order requires: (a) our written quote acceptance; (b) your signed proforma or purchase order; (c) agreed payment terms; (d) confirmed Incoterms (FCA, FOB, CIF). Orders are confirmed upon receipt of the agreed down payment.
5. Payment Terms
Standard payment: 30% down payment upon order confirmation, 70% against bill of lading at shipment. Bank wire in EUR or USD to Mearic corporate accounts (details provided in proforma invoice). Letter of credit accepted for qualifying orders. Late payment beyond 30 days may result in order suspension and interest charges per Turkish Commercial Code.
6. Warranty
Mearic machinery ships with standard 6,000-hour / 12-month warranty (whichever comes first) from Factory Acceptance Test. Warranty covers manufacturing defects in parts and labour. Excluded: operator error, unauthorized modifications, non-genuine spare parts, electrical damage from power surges, force majeure, and wear items past rated life. 7. Service and Spare Parts
Mearic provides lifetime spare parts support for machines shipped. Service response: 48 hours in Türkiye, 72 hours in MENA, 3-5 days in Europe, 5-7 days globally. Remote technical support is available 24/7. Post-warranty service may require a service contract at standard rates published annually.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Mearic's total liability for any claim shall not exceed the purchase price of the specific machinery subject to the claim. We are not liable for: indirect, incidental, or consequential damages; lost profits or business interruption; third-party claims; damages resulting from customer misuse or non-compliance with operating instructions.
9. Dispute Resolution
Disputes shall be resolved through good-faith negotiation. Failing resolution within 60 days, disputes are subject to the exclusive jurisdiction of Istanbul Commercial Courts (Türkiye). For international B2B contracts, the UN Convention on Contracts for the International Sale of Goods (CISG) applies in addition to Turkish law where consistent with the contract.
10. Changes to Terms
We may update these terms periodically. Continued use of the website or placement of new orders after changes constitutes acceptance. Material changes will be communicated via website banner or email to registered customers. Binding contract terms remain governed by the agreement in force at order confirmation.
